DWI While Teaching Driving?

IPSWICH, Massachusetts (CBS) ― 52-year-old Daniel Winsky of Salem, Massachusetts, a driving instructor in Massachusetts is charged with drunk driving for allegedly being under the influence of alcohol while teaching a lesson as a passenger in a car. 

Witnesses apparently called in Winsky to the police as acting seemingly drunk.  Investigators performed a breathalyzer test and Winsky’s blood-alcohol level was at .23, almost 3 times the legal limit in Texas.

The interesting point in this case is whether the teacher was actually operating the vehicle or not, as he was only instructing the student.  He did however, have a brake pedal on his side of the car.
