Speaker Pro Tempore Rosalind Kurita, a Tennessee State Senate Democrat, is trying to ban various types of DUI advertising.
The Senator claims that the advertisements could make people think that it is an acceptable practice to drink and then to drive. It is interesting that the Senator’s view comes out in a year when her opponent for the Democratic nominee in the upcoming elections is a DUI lawyer.
Senator Kurita attached provisions to ban advertising practices used by DUI lawyers including advertising a discounted rate for DUI defense, guaranteeing a certain judgment in the case, or claiming that the attorney had more expertise in the area than another lawyer.
Senator Karita’s opponent, Mr. Tim Barnes, a Clarksville DUI lawyer, feels that the Senator’s proposal has numerous Constitutional problems.
Mr. Barnes feels that the main Constitutional issue stems from the First Amendment.

There needs to be more anti-DUI ads. They need to even be graphic so that people will realize it’s not worth it. They should show what happens when you choose to make that mistake.
