A DWI case against a state district judge has been dropped by the special prosecutor appointed to the case. The case has been dropped apparently due to insufficient evidence.
The special prosecutor, a DWI defense attorney from San Antonio, asked to have the case dropped after he viewed a video taken roughly an hour after the arrest. According to the prosecutor, the judge was clearly not intoxicated in the video. He felt that if the case had gone to court, the verdict would have been not-guilty.
In addition to the inconclusive video, the judge refused to take a breathalyzer. The charges were the result of a February traffic stop.
