A Tarrant County judge has tossed out the blood evidence the prosecution had in a DWI case recently. While collecting blood is legal, it apparently is not legal to have an officer collect the blood, as opposed to a nurse or doctor.
Following an arrest on suspicion of DWI, a suspect is likely to have blood drawn. While most police departments keep a nurse or doctor on staff to do this, the neighborhood of Dalworthington Gardens has trained its police officers to draw the blood.
In addition to the one case in question, Dalworthington Gardens officers have drawn blood for 29 separate Fort Worth DWI arrests. Officials from Fort Worth say they will no longer use the officers for drawing blood.
If you have been charged with driving while intoxicated, contact Grand Prairie DWI lawyer Mark T. Lassiter at 214-457-1668 to discuss your case and to determine your legal options.
