Arlington Mayor Pushes for DWI Checkpoints in Texas

Early this month, Arlington Mayor Robert Cluck went to Austin in support of an effort to get DWI checkpoints legalized. Currently, Texas is one of only 11 states that do not allow these checkpoints.

Mayor Cluck is adamant about getting the law passed this year. However, there are many who are opposed to the idea of DWI checkpoints. A bill for these checkpoints is going to commitee very soon to decide whether or not they will be legalized.

Local City Council Member Arrested for Driving While Intoxicated

Rhenett Gardner, a councilwoman for the city of Hutchins, was arrested early Tuesday morning for D.W.I. by the local police.

Gardner, 51, was in jail as late as 5:00 P.M. the same day as her arrest under a bail posting of $500. The Hutchins chief of police, apparently the only person permitted to comment on such cases, did not return phone calls for more information.

Possible DWI Checkpoints

In 1990, the US Supreme Court ruled that DWI checkpoints are constitutional. The Texas Court of Criminal Appeals later made a stipulation that there must be firm legislative guidelines for such checkpoints. Those have not yet come about, and so neither have DWI checkpoints.

However, Senator John Carona R-Dallas has a bill that he believes will set up just such guidelines, allowing for checkpoints to exist in Texas. These guidelines are detailed in SB 298, and if it is passed, DWI checkpoints could be just around the corner for Texas.

Civil Court Judge Guilty of DWI

Dallas County civil court judge Bruce Priddy was found guilty of DWI on Wednesday after his November 2007 DWI arrest. He has been sentenced to 18 months of probation.

Had he been convicted of a felony or misdemeanor involving official misconduct, Priddy would have been removed from the bench immediately.  As it stands, a complaint about the conviction could still result in Priddy’s removal.
