Texas DA Resigns After DWI Arrest

A prosecutor at the Montgomery County District Attorney’s Office in Texas has resigned following an arrest for DWI last week.

Morgan Anthony Bourque resigned Monday after he was arrested on charges of driving while intoxicated in Houston on Friday. According to a spokesperson for the Montgomery County District Attorney’s Office, the criminal case is ongoing, and Bourque would not necessarily have been removed from office upon conviction. Sources inside the District Attorney’s Office say that all employees were advised to be extremely careful with matters related to drunken driving.

Bourgue was arrested shortly before 1:00 a.m. Friday when officers with the Houston Police Department observed him speeding; he was traveling 50 mph in a 30 mph zone. Police say Bourque complied with field sobriety tests and a breathalyzer test, both of which he failed.

Court Upholds 25-Year DWI Sentence for Texas Man

An appellate court in Texas dismissed an appeal by a man who was sentenced to 25 years in prison for felony DWI.

Walter Malone charged with evading arrest and felony DWI. As Malone had a previous drunk driving conviction, the DWI was automatically upped to a felony, and a district court judge sentenced him to 25 years in prison. Malone appealed the decision, claiming that the judgement in his previous DWI was not signed, making it impossible to try him as a repeat offender.

The appellate court denied Malone’s motion, stating that the lack of signature on the past DWI conviction, while questionable, did not affect the validity of the judgement.
