A Texas man is challenging a 25-year-old DWI charge.
The man was arrested for evading arrest and charged with a felony DWI because of a prior DWI conviction. He is filing an appeal against the indictment because the previous DWI charge was never signed.
He is claiming that since the previous charge was never signed, it is impossible to try him as a repeat offender. The court denied this appeal and he was sentenced to 25-years-years in prison. After the sentencing, the man decided to appeal again.

The Miami Dolphins have declined to make any public comments concerning the DUI arrest of defensive back Will Allen.
According to reports, Allen is being held in pretrial detention center after being arrested in Miami Beach for driving under the influence. Officials with the Miami Beach Police Department say Allen drove his car down a road that was barricaded by police. Allen pulled up to the barrier and informed police officers that he needed to get past the barricade. Officers reported smelling alcohol on his breath, along with bloodshot eyes. Police subsequently performed a field sobriety test on Allen and determined that he was over the legal limit of .08 percent alcohol.
The Miami Dolphins have refused to make any public statement regarding Allen’s arrest, saying that they are still gathering information on the situation.
Allen, meanwhile, is booked on a $1,000 bond.

A school bus driver in Chicago is accused of taking 50 children to their homes while her blood alcohol level was three times the legal limit.
Arrested Tuesday, 54 year-old Betty Burden is facing a charge of aggravated driving while intoxicated. Spokeswoman for the Cook County state’s attorney, Tandra Simonton, said Burden admitted drinking vodka before beginning her bus route at Lions Park Elementary School. Police say Burden smelled of alcohol when they stopped her. She allegedly had a blood alcohol content of .226 percent. The legal limit is .08 percent.
Burden has been suspended by the school district without pay, and could lose her job next week. She is being held in lieu of a $10,000 bail.

A prosecutor at the Montgomery County District Attorney’s Office in Texas has resigned following an arrest for DWI last week.
Morgan Anthony Bourque resigned Monday after he was arrested on charges of driving while intoxicated in Houston on Friday. According to a spokesperson for the Montgomery County District Attorney’s Office, the criminal case is ongoing, and Bourque would not necessarily have been removed from office upon conviction. Sources inside the District Attorney’s Office say that all employees were advised to be extremely careful with matters related to drunken driving.
Bourgue was arrested shortly before 1:00 a.m. Friday when officers with the Houston Police Department observed him speeding; he was traveling 50 mph in a 30 mph zone. Police say Bourque complied with field sobriety tests and a breathalyzer test, both of which he failed.

NBA star Al Jefferson was arrested on charges of fourth-degree DWI Tuesday.
The Timberwolves player was pulled over in downtown Minneapolis after a police officer observed him changing lanes without a signal and speeding. The officer administered a field sobriety test before taking Jefferson to a nearby hospital for a blood test. Jefferson was then taken to jail and charged.
Jefferson has been suspended for the next two Timberwolves games. The center released a statement apologizing to the team, “I want to apologize to the entire Timberwolves organization…my teammates, coaches, and Wolves fans everywhere for my actions Saturday night… I made a very poor decision, and I am truly sorry for that. As a leader on this team, I know that more is expected of me, and I am disappointed in myself.”
